Insurance dispute resolution with an emphasis on property damage, construction, ISR, contractual disputes, public and products liability, professional indemnity, catastrophic personal injury claims and coverage disputes. Background
Kiley has over 10 years' insurance experience gained in well-regarded insurance practices. Kiley's experience lies mainly in conducting litigation on behalf of local and overseas insurers in relation to claims against building professionals, occupiers, manufacturers and suppliers, public authorities, instrumentalities, solicitors and accountants. She also regularly provides advice on policy interpretations.
Experience
Kiley has conducted matters in most Australian jurisdictions including the High Court, Federal Court, NSW Court of Appeal, Supreme Courts of various Australian states and District Courts throughout NSW. Kiley also has experience in various overseas jurisdictions including Singapore, Malaysia, Hong Kong, France, French Polynesia and New Zealand.
Kiley has:
- acted for building professionals in relation to property damage claims and construction disputes;
- acted for architects/project managers in defending claims relating to building defects and seeking to recover prolongation fees and variations;
- acted for geotechnical engineers, surveyors, accountants, lawyers and valuers in relation to allegedly negligent advice;
- acted for manufacturers, suppliers and retailers in product liability including:
- the manufacturer and retailer of horse feed which allegedly poisoned several trotting horses and destroyed the livelihood of their trainer;
- a tyre retailer in relation to a tractor tyre explosion which caused significant injuries to persons attempting to fit the tyre;
- the manufacturer of a roof which collapsed in Malaysia, causing significant damage;
- acted in occupier's liability claims including:
- a warehouse owner in relation to a multi-million dollar fire in Singapore which caused significant damage and business interruption to surrounding businesses;
- owners, managers, contractors and cleaners of commercial retail premises;
- hotel owners and licensees in relation to various personal injury claims, assaults and armed hold-ups;
- school bullying which caused agoraphobia;
- advised insurers and insureds in relation to coverage issues and disputes.
