Background
In Scott’s 18 year career he has developed expertise in a range of complementary dispute related areas including public and products liability, ISR, construction and professional indemnity. His primary focus in recent years has been in the construction sector with an emphasis on contracting, dispute resolution and risk management.
Scott is the firm's managing partner and has been the driver for diversifying the firm's practice, and investing in the systems, people and facilities required to meet the demands of Australia's sophisticated and demanding legal market.
He leads the firm’s construction and dispute resolution teams.
Experience
- Using insurance as a method of mitigating risk, Scott has conducted PPP contract reviews in relation to insurance clauses to ascertain whether the insurance and indemnity clauses are consistent with the cover available under the client’s policies.
- Undertaking contract and risk reviews for construction companies for the purpose of aligning indemnity provisions with contract risks including advising on breaches of policies of insurance and inconsistency in insurance and indemnity provisions in place with principals or sub-contractors.
- Preparing and reviewing facilities management contracts and licenses.
- Resolved claims brought against Leightons Contractors by sub-contractors without recourse to legal proceedings in disputes over the construction of the Sydney Casino including complex issues of indemnity under policies of insurance with the principal and sub-contractors.
- Advising insurers and publicly listed companies on insurance policy interpretation, severity claims, large property damage claims and associated business interruption claims and risk review.
- Advising insurers or acting in the interests of public companies involved in significant property damage claims; domestic building disputes; multi-million dollar contractual disputes and fire claims.
